7. How to Copyright Your Music by Nancy Falkow, Said So Public Relations © 2007 All Rights Reserved. Used By Permission Sometimes musicians think every song written needs to be immediately copywritten with the government, but this isn't always true! Copyright goes into effect automatically the moment the expression of an original idea becomes fixed in a tangible form or medium -- such as written lyrics and/or transcribed notes on music paper and/or an audio recording. When your lyrics do make it to paper, and the music does make it to an audible format, make sure you write or type the copyright information on it. The symbol is a letter C with a circle around it: © the year the song was written and your last name. Once you start distributing your music on a larger scale, play shows and put MP3's up on the web, you should register your music with the US Copyright Office. Now if a situation arises that someone is stealing your music, your registration of copyright is on file and protects you. What can be copywritten? Literary works; musical works, including any accompanying words, dramatic works, including any accompanying music, pantomimes and choreographic works, pictorial, graphic, and sculptural works, motion pictures and other audiovisual works, sound recordings and architectural works. If you are a songwriter and you plan on distributing your music through the web and the world you should copyright your songs. Go to US COPYRIGHT REGISTRATION www.copyright.gov site and download the forms you need. Each situation is different, read all of the information, and figure out which best applies to you. The website has a great FAQ section for any questions about copyright that should arise. You can also call during their regular business hours and talk to a representative to make sure you download the appropriate forms. Call the Copyright Office "forms hotline" and request several copies of the PA Copyright Form. "PA" stands for Performing Arts and is used for songs. If you only write lyrics, obtain the TX Form (for Text). Listen to the recorded message that will instruct you as to how you can request the forms which will be sent to you free of charge. Once you receive the appropriate forms either via download or mail follow the instructions exactly. To register the entire recording so that the album as a whole is also protected by copyright law requires an SR (Sound Recording). Basically you need to put your music and lyrics on a CD, fill out the appropriate forms and write the check. In about 6 weeks, you receive the paperwork and a number of registration. Use this as a Checklist: * A properly completed application form. * A nonrefundable filing fee of $45* (effective July 1, 2006) for each application. * A nonreturnable deposit of the work being registered. Washington, D.C. 20559-6000 Copyright Office phone with human contact: (202) 707-5959 Forms hotline: (202) 707-9100 You can copyright more than one song on one tape or CD by sending it in as an Anthology, the form PA gives directions as to how to do that. But in a nutshell, you put your songs on one format, give it a name like "Greatest Hits" and send it in. This is the best way to save money. When you do this form of copyright, you have to be the sole author of all of the songs on the compilation. You aren't copyrighting each song for $45 - you're copyrighting an entire batch for $45.
