UNBUNDLE YOUR RIGHTS TO MAKE MONEY FROM YOUR MUSIC

As you already know, the digital age has brought massive changes for musicians: you buy, sell and promote your music via the internet. But although most artists know that this happens, they haven't realised that the ways they can make money have changed too - and that unbundling their rights can help them make the best of their music.

What does 'unbundling my rights' mean? Traditionally, collecting societies made an agreement with artists which meant that the society administered all these rights as one bundle, and would only agree to work with artists if they could do this. However, things are changing and artists are starting to unbundle these rights. In the same way that you don't have to buy a mobile phone, landline, fax, cable TV and broadband from the same company, you don't have to ask one collecting society to handle all the rights to your music. Some artists, labels and publishers still find it useful just to deal with one company, but it generally isn't the best way, especially if they want to make money from their music and get it heard.

You should be able to license your music to the best company for you, depending on the level of service you receive for each specific music right. You can limit your agreement with your own national collecting society, asking them to collect for only some rights and not others. What are royalties?

When you write a song, you immediately create composition right. These are the rights to the actual idea for the song, which belong to the person who wrote the music and the person who wrote the lyrics. As soon as the song is recorded, a right to the sound recording is created, and the person or company that has recorded the song usually owns this. If you wrote both the music and the lyrics, then you own 100% of the composition rights; and if you recorded your song yourself on your computer, or paid for studio time to record it, you own 100% of the sound recording rights.

When the music is used in any way - for example, on the radio, as background music, on television or as the soundtrack for a film or computer game - the people who own the rights to it should be paid royalties. Since keeping track of which music is used is a complex and time-consuming business, artists, record labels and publishers ask collecting societies to do it for them.

What is a collecting society?

Collecting societies (called 'Performance Rights Organisations' or PROs in Canada and the US) enforce your rights, sell people non-exclusive licences to use your work, collect your royalties, then work out how much you are due and pay you, minus an administration fee. They also arrange for other collecting societies (for example, in other countries) to collect your royalties. Collecting societies don't just sell licences to use individual songs; they also offer 'blanket licences', which allow the licensee (the person buying the licence) to use the collecting society's entire catalogue for a set period of time. Collecting societies in European countries had a monopoly on this business until the European Commission ruled that this was unfair in 2008.

How does a collecting society split royalties?

Since collecting societies often don't have a record of how many times a certain song is played, it's difficult for them to calculate accurately what they should be paying their artists, record labels and publishers. They often use 'sampling', which involves asking a small number of music users to tell them which songs they're playing and how much they're playing them. They usually plug this data into a formula, which they use to work out how much to pay each artist. However, the results of this tend to get very distorted, since musical tastes vary widely - and these calculations often leave independent artists with little or nothing. Most artists have never actually been paid when their music has been used as background music, even if they're quite well known!

When your music is played abroad, it gets even more complicated. Your national collecting society asks the other country's national collecting society to decide how much your music is being played (using a similar formula) and therefore how much you should be paid, and receives this money. It then deducts its own administration fee and passes the remainder to you - assuming there's anything left.

Why can't royalties be split more fairly?

Most collecting societies often still rely on outdated business models and royalty distribution procedures, even though technology and internet tools should have made these obsolete.
